The type of personal information we collect
We currently collect and process the following information:
- Personal identifiers, contacts and characteristics (for example, name and contact details)
- Name, address, date of birth, National Insurance number, telephone numbers, mobile numbers, email addresses, bank details, next of kin details, legal representatives, GP, health professionals details, health, disability and medication information.
How we get the personal information and why we have it
Most of the personal information we process is provided to us directly by you for one of the following reasons:
Optimum Care collects your personal information to help us provide you the best care and support. Some of this information will be given to us by the Partner Agency, the hospital or your GP in order that the care and support can begin without delay or continue without a break. We may ask for other information directly, but we will always tell you exactly what we may need, why we need it and we will always ask your permission to use it.
We also receive personal information indirectly, from the following sources in the following scenarios:
- Carers that have delivered care or support to you and have needed to inform us of a matter that we need to know.
- Health professionals that have visited you or made aware of a matter that we need to know.
- Other individuals or professionals that have shared information on a need to know basis.
We use the information that you have given us in order to maintain the quality and safety of the care and support we provide for you. We will not use the information for any other purpose without your consent. We will not disclose your personal information to a third party without your consent unless we are legally obliged to do so or in the case of an emergency.
We will always inform you what information we are keeping about you and what we are using it for. We will provide you with the information we are keeping should you request it, or to somebody else if you give them permission to have it. You may also make choices about Optimum Care’s collection and use of your information. You may also ask us to delete, correct or stop using the information we have about you. If we are unable to do so, we will always explain why. We will not charge you for any of these requests.
We may share this information with other care providers in situations where we need them to provide care on behalf of us where we have a shortage of staff.
Under the General Data Protection Regulation (GDPR), the lawful bases we rely on for processing this information are:
(a) Your consent. You are able to remove your consent at any time. You can do this by contacting Mohammad Yousaf, Data Officer.
(b) We have a contractual obligation.
(c) We have a legal obligation.
(d) We have a vital interest.
(e) We need it to perform a public task.
(f) We have a legitimate interest.
How we store your personal information
We will keep your electronic information safe by protecting it with electronic safeguards and controlling and monitoring who has access to it. We will keep any documents securely locked away in premises that are also secure and ensure all our employees are trained and up to date in information security and data protection.
Please advise us in writing as to any changes in your circumstances. Obviously it is preferable for us to retain up to date information. We will amend details as required. We are, however, obliged and permitted by law and regulation to retain certain types of data for a minimum period of time. The minimum period of time tends to be for six years but can be longer if the statute or regulation requires.
We will then dispose your paper information by shredding and digital data by using specialist IT methods of disposal.
Your data protection rights
Under data protection law, you have rights including:
Your right of access – You have the right to ask us for copies of your personal information.
Your right to rectification – You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
Your right to erasure – You have the right to ask us to erase your personal information in certain circumstances.
Your right to restriction of processing – You have the right to ask us to restrict the processing of your personal information in certain circumstances.
Your right to object to processing – You have the the right to object to the processing of your personal information in certain circumstances.
Your right to data portability – You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.
You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
